Terms and Conditions of Service
This document outlines the terms and conditions governing the professional relationship between Your Vehicles Care ("we," "us," "our") and our clients ("you," "your"). Engagement of our services signifies your explicit agreement to adhere to these terms.
- Service Agreement: Engagement of our services, whether verbal, written, or digital (including checking the agreement box upon booking), constitutes a legally binding agreement to these terms and conditions.
- Payment Terms & Cash Handling: Full payment for all rendered services and supplied parts is strictly required immediately upon completion of the work. Payments must be routed digitally via our official platform gateway (UPI, Credit/Debit Cards) directly to the company account. If a cash payment is made directly to the dispatched mechanic, it must strictly match the digital invoice provided. For any spare part procurement exceeding ₹2,000, a mandatory digital advance payment is required before our delivery network dispatches the part to your location.
- Service Estimates vs. Final Cost: All initial service charges are professional estimates based on the reported issue, standard labor times, and typical parts costs. The final cost may be subject to adjustment if unforeseen complications or additional faults are discovered, the price of required parts deviates significantly, or additional labor is required. Any significant deviation (e.g., more than 15% variance) will be communicated to you for approval before any additional work is performed.
- Diagnostic Services: In cases where the primary service is diagnostic, the quoted fee covers the mechanic's time, expertise, and use of specialized equipment to identify the problem(s). This diagnostic fee is payable in full upon completion of the diagnostic work, regardless of whether you choose to proceed with the recommended repairs.
- Spare Parts Procurement & No-Return Policy: To ensure rapid roadside assistance, parts are procured in real-time through our vendor network based on the on-site mechanic’s diagnosis. You acknowledge that once a part (particularly electronic and sealed components) is purchased and opened for your vehicle, it is strictly non-refundable. If your vehicle suffers from compounding faults and the newly installed part does not fully mobilize the vehicle due to secondary underlying issues, you remain fully liable for the cost of the procured part and the associated labor.
- Client-Supplied Parts: We may agree to install parts supplied by you. However, our service warranty will cover only the workmanship of the installation. We offer absolutely no warranty, guarantee, or liability coverage for any client-supplied parts and assume no liability for damages caused by their failure. If a client-supplied part is incorrect or faulty, you will still be liable for the labor costs incurred up to that point.
- Cancellation Policy: You may cancel a service request at any time. However, if a mechanic has already been dispatched to your location at the time of cancellation, a standard dispatch fee will be applied to cover fuel and operational costs.
- Service Warranty & Exclusions: We provide a limited warranty solely on our workmanship and the new parts we directly supply. This warranty covers the specific repair performed and the specific part(s) installed by us. It is immediately voided if the vehicle is subjected to misuse, negligence, accident, modification, if the installed part is tampered with, or if further repairs related to our service are attempted by a third party. To make a warranty claim, you must contact us immediately.
-
Limitation of Liability & Damage Waiver: By engaging our emergency roadside services, you acknowledge that field repairs carry inherent environmental and mechanical risks. Your Vehicles Care acts as a tech-enabled dispatch and service platform. To the maximum extent permitted by applicable Indian law, our total aggregate liability for any claim, damage, or dispute is strictly capped at the direct amount paid by you for the specific service and parts rendered during that incident. Under no circumstances shall Your Vehicles Care, its proprietor, mechanics, or delivery personnel be held legally or financially liable for:
- Indirect, incidental, or consequential damages, including loss of income, missed travel, or secondary towing charges.
- Pre-existing mechanical or electrical faults that worsen during or after the repair process.
- Accidental physical damage to the vehicle (e.g., jack slippage, electrical shorting) occurring at the uncontrolled roadside environment.
- Delays in service or part delivery due to traffic, vendor stock unavailability, or force majeure events.
- Anti-Fraud and Zero Tolerance Policy: Your Vehicles Care maintains a strict zero-tolerance policy against any fraudulent activities, unauthorized overcharging, or misrepresentation by independent mechanics dispatched through our platform. While we thoroughly vet our network, mechanics act as independent contractors. In the event of a verified scam or fraudulent behavior, Your Vehicles Care will immediately terminate the mechanic's platform access and fully cooperate with local law enforcement to assist the customer. However, under our Limitation of Liability, Your Vehicles Care shall not be held financially or legally responsible for independent criminal acts, off-platform solicitations, or private side-deals committed by third-party mechanics.
- Client Responsibilities, Safety, and Access: It is your responsibility to provide accurate vehicle information and ensure the vehicle is in a safe, accessible, and legally permissible location for our mechanic to work. The work area must be on level, solid ground. Our mechanics reserve the right to decline service if the location is deemed unsafe or the client is hostile, and a dispatch fee may still apply.
- Designated Service Area: Our mobile services are available within a predefined operational territory. Requests outside this area may incur additional fees or may not be feasible.
- Disposal of Parts: All parts replaced during service will be disposed of by us in an environmentally responsible manner, unless you specifically request to keep the old parts at the time of service.
- Data Privacy and Usage: All personal and vehicle data collected are handled with strict confidentiality in accordance with applicable data protection regulations.
- Governing Law: These terms are governed by the laws of Madhya Pradesh, India. In the event of a dispute, both parties agree to first attempt to resolve the issue amicably.
- Amendments to Terms: Your Vehicles Care reserves the right to review, update, and modify these terms and conditions at any time. The version of the terms in effect at the time of your booking will apply to that service.
